TERMS OF SERVICE
These Terms of Service (“Terms”) are a legal agreement between you and NeuTrainer LLC (“NeuTrainer,” “we,” “us,” or “our”) governing your use of the NeuTrainer website (neutrainer.com) and mobile application (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Your Account
The Service is intended for athletes and the adults who support them.
- If you are 18 or older, you may create an account for yourself.
- If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian. For athletes under 13, a parent or guardian must create or approve the account and agree to these Terms and our Privacy Policy on the child’s behalf.
- A parent or guardian who sets up or approves a minor’s account is responsible for that account and agrees to these Terms on the minor’s behalf.
2. Your Account
You agree to provide accurate information, keep your login credentials secure, and be responsible for activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use.
3. Roles and Permissions
NeuTrainer supports different roles — athlete, parent, coach, and trainer — each with different access to information and features. By connecting with a team, coach, trainer, or family member, you understand that certain information will be shared as described in our Privacy Policy. Only connect with people and organizations you trust.
4. Subscriptions and Payments
Some features (such as trainer tools and AI Coaches) may require a paid subscription. Subscriptions are billed through the Apple App Store (and, in the future, Google Play), subject to those platforms’ terms. Prices, billing cycles, and renewal terms will be disclosed at the point of purchase. Manage or cancel subscriptions through your app store account settings. Except where required by law or the applicable app store’s policies, payments are non-refundable.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Upload content that is false, harmful, harassing, or that infringes others’ rights;
- Access or attempt to access data you are not authorized to see;
- Interfere with, disrupt, or attempt to compromise the security or integrity of the Service;
- Reverse engineer, scrape, or copy the Service except as permitted by law; or
- Misrepresent your identity or your relationship to an athlete.
6. User Content
You retain ownership of the content you submit (such as profiles, logs, notes, and messages). You grant NeuTrainer a limited license to host, process, and display that content as necessary to operate and provide the Service. You are responsible for the content you submit and confirm you have the right to submit it.
7. Intellectual Property
The Service, including its software, design, text, graphics, and logos, is owned by NeuTrainer LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not use our name, logo, or branding without our written permission.
8. Health and Safety Disclaimer
NeuTrainer is a training, tracking, and well-being tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
- Information in the Service — including readiness flags, pain or injury indicators, training-load insights, and AI-generated suggestions — is for general informational purposes only and is not a substitute for professional medical, athletic, or coaching judgment.
- Always seek the advice of a qualified physician, athletic trainer, or other healthcare professional regarding any medical condition, injury, illness, or before beginning or changing any training program.
- Never disregard or delay professional medical advice because of something you read or saw in the Service.
- In an emergency, call your local emergency number immediately.
- You are responsible for decisions made based on information in the Service, and you use it at your own risk.
9. Third-Party Services
The Service relies on third-party providers (such as Supabase for hosting, the Apple App Store for distribution and billing, and Anthropic (Claude) for optional AI features). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION IT PROVIDES IS ACCURATE OR COMPLETE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEUTRAINER LLC AND ITS OWNERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
12. Idemnification
You agree to indemnify and hold harmless NeuTrainer LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as Sections 8, 10, 11, and 12) will survive.
14. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Illinois, unless otherwise required by applicable law.
15. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last Updated” date above and, for material changes, provide additional notice as appropriate. Your continued use of the Service after an update means you accept the revised Terms.
